Action: TG RERA imposed a fine of Rs 2.81 lakh on the builder

An application was given demanding occupancy certificate from the builder
Hyderabad: The Telangana Real Estate Regulatory Authority has directed city-based builder RR Constructions to pay a penalty of Rs 2.81 lakh for failing to register its project Sri Vajra Residency at Lalitha Nagar in Adikmet. In its order issued on July 1, TG RERA also directed that the respondent should immediately apply for obtaining an 'Occupancy Certificate' , which should then be provided to the association of allottees. Mudrakarth Veenadhari (complainant) lives in flat number 302 of Sri Vajra Residency at Lalitha Nagar in Adikmet and has complained that she had given an application to the builder of Sri Vajra Residency seeking an occupancy certificate for her flat.
The respondent was requested multiple times to show any documentary proof or evidence whether he had applied or not. 'Subsequently, I conducted independent verification with GHMC Secunderabad zone officials and found that no such application was made even after two and a half years of completion of the construction,' Veenadhari complained to the TG RERA authority.
Permission was given to build only eight flats in the building plan
The complainant also alleged that the respondent constructed 10 flats on a site of 459.22 sq m, while the approved building plan permitted only eight flats. The builder committed unauthorized violation of RERA Act 2016, and he accordingly complained to TG RERA. Further, he complained to the RERA authority about several deficiencies such as waterlogging in the parking area due to lack of adequate slope and rainwater harvesting, poor quality of interior and exterior painting leading to fading and staining, poor quality of plumbing and sanitary fittings requiring premature replacement, health hazard due to cement patches and mold growth on minor impact due to poor quality of plaster, and non-provision of transformers.
Respondent liable for penalty as per RERA Act 2016
The respondent denied the allegations levelled by the complainant. He said that the case is an abuse of the legal process and should be dismissed with severe penalties. Based on the facts and evidence presented by the respondent, TG RERA chairman N Satyanarayana and two other members of TG RERA, including K Srinivas Rao, Lakshmi Narayana Jannu, issued orders on July 1 and said that the respondent is liable for penalties as per the RERA Act 2016, and directed TG RERA to pay a penalty of Rs 2,81,276 within 30 days.
As per the order of the TG RERA chairman, 'the respondent has to immediately apply for obtaining an 'Occupancy Certificate' (OC), which should be subsequently provided to the association of allottees.' The builder (respondent) has also been directed to fix the waterlogging within 30 days from the date of receipt of the TG RERA order and ensure that the transformer is operational.
